Ardgour Support App Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Ardgour Support application available at https://account.ardgour.app and related interfaces (collectively, the “Service”). By creating an account or using the Service you agree to these Terms and our Privacy Statement. If you do not agree, do not use the Service.
1. Eligibility & Account Security
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. You agree to provide accurate account information, maintain a secure password, keep your devices safe, and notify us promptly of any unauthorised access. Passwords are stored using bcrypt hashes.
2. Service Description
- AI-guided conversations, summaries, themes, homework, reminders, and support-contact prompts are generated using OpenAI API models based on recent session history and your profile context.
- Optional audio uploads are transcribed with OpenAI’s speech-to-text service.
- Emails are delivered via SendGrid; SMS reminders and trusted-contact outreach are handled by ClickSend.
- Billing is processed through Stripe Checkout and the Stripe Billing Portal. Ardgour stores Stripe-issued customer and subscription IDs only; payment card data is handled by Stripe.
- Reminder scheduling, outreach logging, and analytics operate through our reminder worker and Postgres-backed session store hosted on managed infrastructure.
3. AI-Generated Content & Limitations
Responses and insights are generated automatically and may contain inaccuracies, omissions, or bias. You are responsible for evaluating outputs before relying on them. Ardgour Support is not HIPAA, SOC 2, ISO, or similar certification compliant at this time, and should not be used to store protected health information where such certification is required.
4. No Medical Advice
The Service provides supportive coaching and organisational tools. It is not medical, psychological, or crisis care. In emergencies, contact your local emergency number or crisis hotline immediately.
5. Support Contacts & Outreach
When you add support contacts, you confirm you have permission to share their details. Outreach occurs only when you explicitly request it or when you enable automated outreach, in which case Ardgour sends the configured message on your behalf.
6. Communications
You consent to receive transactional emails and SMS, including session recaps, reminders, security notices, and escalation updates. Standard carrier rates may apply. You can disable non-essential notifications by updating settings or deleting contacts, though critical account communications may still be sent.
7. Service Availability & Support
We intend for the Service to be available 24/7 but availability is not guaranteed. Planned maintenance or unexpected outages may occur. Support requests can be sent to [email protected]; response times vary based on demand and severity.
8. Subscriptions & Billing
- Plans currently include Free, Supporter, and Accountability tiers with features shown in-app and during checkout.
- Paid plans auto-renew unless cancelled through the Stripe Billing Portal or by contacting [email protected].
- Promotional trials, credits, or discounts (when offered) are subject to the terms presented with the offer and may be modified or withdrawn.
- Fees are non-refundable except where required by applicable law. We may suspend or downgrade the Service if payment fails or fraud is suspected.
- Stripe webhook events update your subscription status; you authorise us to communicate with Stripe on your behalf to administer billing.
9. Acceptable Use
You must not upload unlawful, abusive, discriminatory, or infringing content; attempt to reverse engineer or disrupt the Service; harvest data from other users; or use the platform for unsolicited communications. We may suspend or terminate accounts for violations.
10. Content Ownership & Licence
You retain ownership of your inputs. You grant Ardgour a licence to store, display, process, and transmit your content as necessary to operate and improve the Service. We may aggregate and anonymise data for analytics and product development.
11. Feedback
If you submit ideas, suggestions, or feedback, you grant Ardgour a perpetual, irrevocable, royalty-free licence to use them without obligation or compensation. Feedback is optional and voluntary.
12. Data Deletion
You may delete your profile within the app. This removes associated sessions, reminders, contacts, and tokens, subject to retention required for legal, dispute, billing, or safety purposes.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, fail to pay fees, or create security risks. Upon termination we may delete or deactivate your account and data. Fees already paid are non-refundable unless required by law.
14. Service Changes
We may modify or discontinue features. Material changes will be announced in-app or by email where practicable. Continued use after changes become effective constitutes acceptance.
15. Disclaimers & Liability
The Service is provided “as is” without warranties of any kind except as required by law. Ardgour’s total liability arising from the Service is limited to the greater of the fees you paid in the prior three (3) months or USD $50, except where liability cannot be limited by law.
16. Indemnity
You agree to indemnify and hold Ardgour harmless from claims, damages, or expenses arising from your misuse of the Service or breach of these Terms.
17. Export & Sanctions Compliance
You represent that you are not located in, or a resident of, any country subject to embargo or sanctions, and are not on any government list of prohibited persons. You will comply with applicable export control and sanctions laws.
18. Governing Law & Disputes
These Terms are governed by the laws of Australia. Before filing a formal claim, you agree to contact us at [email protected] and allow 30 days to resolve the dispute informally. Any disputes will be brought exclusively in the courts located in Australia, and you consent to their jurisdiction.
19. Survival
Sections that by their nature should survive termination (including 3, 6–19) will continue to apply after your access ends.
